The Delhi High Court on Tuesday dismissed a petition seeking to hold the National Eligibility cum Entrance Test (NEET-UG) twice a year, similar to the Joint Entrance Examination (JEE) for engineering courses.

A bench comprising Chief Justice D.K. Upadhyaya and Justice Tushar Rao Gedela stated that the decision to conduct the examination once or multiple times a year falls within the administrative domain and is beyond judicial intervention.

"It is up to the authorities to decide on such matters. This is a policy decision of the government," the bench observed.

While disposing of the petition, the court granted the petitioner— a coaching center teacher— the liberty to present a formal representation to the relevant authorities. The court also directed that if such a request is made, the authorities must consider it and take an appropriate decision under the law.

The petitioner argued that the JEE (Mains) examination is conducted in multiple shifts, allowing students several opportunities to improve their scores and alleviate psychological stress. In contrast, NEET-UG aspirants are given only a single attempt, creating undue pressure.

However, the court pointed out that several other competitive examinations also provide only one attempt, reinforcing that such policies vary based on administrative decisions.
